Submission of Prior Notice to FDA for Articles of Imported Food During Periods when ACS/ABI is Not Operational

Brokers and other users of the ABI/ACS system are reminded that the Prior Notice Interim Final Rule states at 1.280(b):

If a custom broker's or self-filer's system is not working or if the ABI/ACS interface is not working, prior notice must be submitted through the FDA PN System Interface.

FDA's PN System Interface (PNSI) may be accessed via the Internet.

The Interim Final Rule also states at 1.283 that articles of food which arrive in the United States without adequate Prior Notice are subject to refusal of admission and may be held at the port of arrival or other secure location until adequate Prior Notice is submitted. The entire Interim Final Rule may be viewed online.

Filers are reminded that they will need to present a paper copy of the Prior Notice confirmation page from PNSI to CBP officers when clearing their shipments.
