BACKGROUND:

Under the *Federal Food, Drug, and Cosmetic Act,* food in package form is required to bear certain mandatory label information. Section 30l(k) prohibits the misbranding of articles (such as by removal of the mandatory label information) after shipment in interstate commerce.

POLICY:

Any food or beverage dispensed in vending machines after movement in interstate commerce should carry the mandatory label information required by law. *Products which are already packaged prior to dispensing should have the mandatory labeling on the product visible to the consumer prior to purchase or be otherwise displayed on the vending machine. With respect to foods actually prepared by or processed by the vending machine, the mandatory information should be displayed on the vending machine.*
